These Terms of Use ("Terms") govern your access to and use of the mobile application PlanIt Earth, the PlanIt+ membership, related websites, cloud sync, account services, and support services provided by PlanIt ("we", "us", or "our"). By downloading, accessing, or using PlanIt Earth, you agree to these Terms. If you do not agree, do not use the App.
PlanIt Earth is an astronomy and photography planning tool. It helps you visualize and plan shots involving the Sun, Moon, stars, Milky Way, eclipses, satellites, maps, terrain, weather, augmented-reality sky overlays, virtual-reality previews, saved plans, markers, tracks, and related planning data. Some features work offline; other features require network access, third-party services, an optional account, or a PlanIt+ membership.
You may use the App only if you can legally enter into these Terms. Some features may require an account. You are responsible for the accuracy of the information you provide and for keeping your sign-in credentials secure. You must not share your password or allow unauthorized access to your account.
You are responsible for all activity under your account except activity caused by our failure to use reasonable security measures. If you believe your account has been compromised, contact us promptly.
PlanIt+ unlocks premium features in PlanIt Earth and may also apply to other PlanIt apps where stated in the purchase screen. Available plans, prices, currencies, trial offers, renewal periods, and feature lists may vary by country, platform, store, and time.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App and PlanIt+ for your own photography planning and related personal or professional work. PlanIt+ is licensed for use on your own devices and account. Sharing, reselling, renting, sublicensing, or pooling account access is not allowed.
We may apply reasonable device, platform, or anti-abuse limits to protect the service and other customers. Heavy account sharing, automated access, credential resale, or attempts to bypass purchase checks may result in temporary or permanent restrictions.
You keep ownership of plans, markers, tracks, photos, notes, feedback, and other content you create or upload through the App ("Your Content"). You grant us the rights needed to operate the App and related services, such as storing, backing up, syncing, displaying, processing, and transmitting Your Content at your direction.
If you submit feedback, bug reports, suggestions, translations, feature ideas, or community markers, you allow us to use them to improve, support, and operate the App without additional compensation. Community contributions may be reviewed, edited, rejected, or removed.

PlanIt Earth is a planning aid, not a guarantee of sky conditions, visibility, access, safety, legal permission, or photographic results.
Astronomical calculations, maps, satellite positions, terrain, weather, cloud forecasts, geocoding, light-pollution data, AR alignment, device sensors, and third-party data can be inaccurate, delayed, unavailable, or affected by local conditions. Always verify conditions, permissions, routes, tides, weather, hazards, regulations, and site access independently before traveling or shooting.
The App may display, link to, or depend on third-party services such as app stores, map providers, weather providers, geocoding services, cloud hosting, crash reporting, payment processing, or services you connect with your own account or API key. Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party content, availability, pricing, limits, or changes.

The App, software, design, text, graphics, logos, calculations, and other materials provided by us are owned by us or our licensors and are protected by intellectual-property laws. These Terms do not transfer ownership of the App or our materials to you.
You may stop using the App at any time. We may suspend or terminate access to the App, PlanIt+, cloud sync, or account services if you violate these Terms, create risk for the service or other users, or if we are required to do so by law, store policy, or platform rules.
To the maximum extent permitted by law, the App and services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost opportunities, travel costs, equipment costs, business interruption, or photographic results. Our total liability for any claim relating to the App or these Terms will not exceed the amount you paid for the App or PlanIt+ during the twelve months before the claim, or US$50 if you paid nothing, unless applicable law requires otherwise.
We may update these Terms from time to time. If changes are material, we will provide notice in a reasonable way, such as in the App or on our website. Your continued use of the App after the updated Terms become effective means you accept the updated Terms.
